Отнесение генерального атторнея США как к первой, так и ко второй группе является не совсем правомерным. Генеральный атторней как бы совмещает в одном лице и функции министра юстиции, и функции генерального прокурора. Как генеральный прокурор он наделен правом осуществлять общий надзор за исполнением разведывательными службами федеральных законов. Как министр юстиции он выступает вышестоящим административным начальником по отношению к состоящему в структуре его министерства Федеральному бюро расследований США (и ряду других ведомств). Все же, автор счел более оправданным отнести генерального атторнея ко второй группе, поскольку осуществляемые им контрольные полномочия относятся не только к ФБР, но и ко всем иным федеральным органам. Ниже будут рассмотрены лишь те контрольные функции генерального атторнея, которые осуществляются им не в связи с отношениями административной подчиненности между ним и состоящими в структуре министерства юстиции органами, а в силу его прокурорских обязанностей в сфере осуществления общего надзора за законностью.
