Предисловие

В настоящее время исследования в области биотехнологий и генетики являются достаточно инновационными. Наука и техника сейчас переживают стремительное развитие, что выходит за рамки исключительно научных интересов, поскольку затрагивает социальные сферы жизнедеятельности человека и предпринимательской деятельности. К таким сферам можно отнести: медицину, фармацевтику, развитие человека, растениеводство, животноводство, сельское хозяйство, пищевую промышленность, экологические технологии, страхование и юридические науки. Поэтому нельзя исключать, что для этих новых сфер требуется законодательное регулирование, которое позволит с наименьшими рисками улучшить оборотоспособность объектов и участников предпринимательской деятельности. В частности, с помощью механизмов ДНК создаются системы безопасности, которые регулируют доступ человека к зданиям и, возможно, в ближайшем будущем заменят и электронные замки, в том числе и к автомобилю. Микроорганизмы могут быть подвергнуты генной мутации с целью уменьшения вредных веществ в атмосфере, что способствует улучшению экологической обстановки в неблагоприятных регионах. Применяя методы клонирования и используя различные генные модификации, можно на основе материала, оставшегося от вымерших видов животных и растений, создавать новые виды животных или растений. Генная инженерия предоставляет в настоящее время широкие возможности, в том числе и некоторое позитивное вмешательство в процесс эволюции, становясь ее частью.

Следует отметить, что в настоящее время редкая техническая область настолько противоречива, как исследования, связанные с геномом или биотехнологиями. Это связано с тем, что, с одной стороны, такие исследования вторгаются именно в процесс эволюции человека, что в соответствии с законодательством некоторых стран подвергается критике. С другой стороны, подобные исследования направлены на получение информации о путях лечения таких болезней, как ревматизм, СПИД, диабет, рак и иные. Таким образом, в контексте исследования генома человека уже расшифровано более 1400 генов болезней человека.

Кроме того, биотехнология является важной сферой применения с огромными перспективами экономического роста и значительным инновационным потенциалом для развитых экономик. В связи с этим ее эффективное применение в XXI веке невозможно без информационных технологий.

Настоящая монография является результатом рассмотрения ряда проблем в различных отраслях как законодательства, так и сфер общественной жизни участниками Международного симпозиума «Право и современные технологии в медицине», которая прошла в Московском государственном юридическом университете имени О. Е. Кутафина (МГЮА) 15–17 мая 2019 года при информационной поддержке Издательского центра Московского государственного юридического университета имени О. Е. Кутафина, журналов: «Kutafin University Law Review (KULawR)», «LEX RUSSICA».
